Trademarks: The What and Why
Trademarks and servicemarks protect brands and products. Both State and Federal law provide trademark protection. Like copyright, Federal registration is not required unless you want to enforce your mark under Federal law. However, like copyright, not registering your mark prevents you from taking advantage of the full benefits Federal trademark protection has to offer. A trademark owner must also conduct due diligence to enforce their mark, or they risk losing trademark protection.
Protect your brand!
Mr. Grosland’s practice includes trademark registration, renewals, incontestability and renewal calculation, maintenance filings, enforcement and rudimentary mark search. If you want to protect your brand, make sure start early by seeking guidance of a trademark lawyer.
Why you should not handle trademarks by yourself
Trademark law is more complicated than simply filing a registration. Not knowing the intricacies of choosing your mark, using it, and enforcing it, can result in your brand being compromised or even being designated as worthless. Answering these questions before you start using your brand in commerce is critical and should not be overlooked.
