Trademarks and servicemarks protect brands and products. Both State and Federal law provide trademark protection. Like copyright, Federal registration is not required unless you want to enforce your mark under Federal law.  However, like copyright, not registering your mark prevents you from taking advantage of the full benefits Federal trademark protection has to offer.
